1. Agreement
These Terms of Service ("Terms") govern your use of mytechgenie.ai and the MyTechGenie platform (collectively, the "Service") operated by MyTechGenie, Inc. ("MyTechGenie," "we," "our," "us"). By accessing or using the Service, you agree to be bound by these Terms.
Customer use of the platform is also governed by a separate Customer Agreement signed at onboarding, which prevails over these Terms where it conflicts.
2. Use of the Service
2.1 Eligibility
You must be at least 18 years old and have the authority to bind your organization to use the Service.
2.2 Account responsibility
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
2.3 Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any law
- Attempt to reverse engineer, scrape, or otherwise extract source code from the platform
- Use the Service to send spam, harass others, or transmit malware
- Impersonate any person or misrepresent your affiliation with any entity
- Interfere with or disrupt the Service or servers connected to the Service
3. Intellectual property
The Service, including its underlying software, design, and content, is owned by MyTechGenie and is protected by copyright, trademark, and other laws. Your customer-specific configuration, knowledge base, and conversation data remain yours; we do not claim ownership of customer content.
4. Customer data
You retain all rights to your customer data. We process it only to provide the Service to you, subject to your Customer Agreement and, where applicable, a Business Associate Agreement.
Because the Genie model deployment runs inside your own cloud environment, MyTechGenie does not store the substantive content of end-user conversations on our servers. See our Privacy Policy for details.
5. Fees and payment
If you are a paying customer, fees, billing terms, and renewal terms are set forth in your Customer Agreement or order form. All fees are non-refundable unless stated otherwise. We may change pricing for future renewal terms with reasonable advance notice.
6. Term and termination
These Terms remain in effect while you use the Service. You can stop using the Service at any time. We may suspend or terminate access for material breach of these Terms, for non-payment, or as otherwise permitted by your Customer Agreement.
Upon termination, we will make customer data available for export for a reasonable period and then delete or anonymize it in accordance with our Privacy Policy and applicable law.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
AI-generated responses are based on the knowledge base and configuration you provide. You are responsible for reviewing and configuring the Service appropriately for your use case. The Service is not a substitute for professional medical, legal, financial, or other specialized advice.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MYTECHGENIE'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE FEES PAID BY YOU TO MYTECHGENIE IN THE 12 MONTHS PRECEDING THE CLAIM. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
9. Indemnification
You agree to indemnify and hold MyTechGenie harmless from any claims arising out of your use of the Service in violation of these Terms, your customer data, or your violation of any law or rights of a third party.
10. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in Delaware.
11. Changes
We may update these Terms from time to time. For material changes, we will notify you by email or through the Service. Continued use after a change constitutes acceptance.
